2. ATTACHMENT: Excerpt from SHIVER Incident Review Board Final Judgment.

Based on the testimony of the surviving members of Squad 1051, Sgt. Thomas Cauley commanding; the operative debriefing filed by operatives Carol Ann Ripley, SCL 6A and Cloud, SCL 6A; and the testimony of Operative Trainee Copper, SCL 11, this Board finds the following:

  1. That signs of Carrien infestation of the area in question were sufficiently apparent to have led a reasonable person to suspect imminent danger to the members of Squad 1051;
  2. That officers Lopez and Fisk in fact noticed such signs and counseled avoidance of the area and summons of an operative squad;
  3. That Sgt. Cauley ignored such advice and ordered Squad 1051 to proceed through the area in question;
  4. That as a result, squad 1051 was attacked by a pack of Carriens;
  5. That the attack resulted in damage to SLA property, viz. a FEN `Battle-Taxi' Armored Personnel Carrier, Serial Number FEN-BT654-886330-117/s;
  6. That said damage was the direct result of Sgt. Cauley's actions, and that such actions reflected a grave error in judgment;
  7. That Sgt. Cauley further demonstrated conduct unbecoming an officer when, upon being rescued by operatives Ripley and Cloud, he subjected both operatives and the then-civilian Copper to verbal and physical abuse;
  8. That Sgt. Cauley further subjected Operative Trainee Copper to verbal abuse during the course of this hearing, and that such abuse constitutes further conduct unbecoming an officer;
  9. That the SHIVER forces of this precinct are suffering personnel shortages that make further permanent diminution of the effective force of this precinct inadvisable at this time;

THEREFORE:

It is the judgment of this Board that Sgt. Cauley be suspended from service without pay for the period of one month, and that he be returned to duty at the end of that time upon his demonstration of proper remorse for his actions. It is this Board's hope that Sgt. Cauley will benefit from the time away from his duties by reflecting on the serious nature of his duty as a SHIVER officer and the commitment to the community and to his fellow officers he is expected to manifest.

3. ATTACHMENT: Excerpt from SHIVER Conduct Review Board Final Judgment
  1. That officer DeSilva's alleges:
    1. that Senior Sgt. Cauley beat the civilian in question (one "Copper") upon more than one occasion;
    2. that such beatings were accompanied by demands by Sgt. Cauley for information as to the whereabouts of the civilian's sister, or demands for money or drugs;
    3. that even if money or drugs were provided, the beatings occasionally continued if Sgt. Cauley was "in a bad mood;"
    4. and that upon the most recent occasion of such alleged beating officer DeSilva could not bring himself to cooperate in such a practice and sought to prevent Sgt. Cauley from administering such beating;
  2. That Senior Sgt. Cauley alleges
    1. that officer DeSilva's allegations are fabrications;
    2. that officer DeSilva resents Sgt. Cauley's position of authority;
    3. that officer DeSilva has manifested disciplinary problems since being placed under Sgt. Cauley's command;
    4. that Sgt. Cauley had never previously encountered the civilian Copper;
    5. that the civilian Copper had withheld information that might lead to the arrest of individuals engaged in the criminal enterprise of slavery known as the Skin Trade;
    6. that officer DeSilva inappropriately sought to interfere in the questioning of a suspected criminal accomplice, to whit, the civilian Copper; and
    7. that his actions in administering physical correction to officer DeSilva were within the purview of his authority.
  3. That officer DeSilva's allegations are without merit;
  4. That Senior Sgt. Cauley's allegations (a) through (f) have merit; and
  5. That Senior Sgt. Cauley exceeded his authority in administering physical correction to officer DeSilva in a non-combat, non-Sleeper environment.

THEREFORE:

It is the judgment of this Board that Officer Wayne DeSilva be dishonorably discharged from service as a SHIVER officer, such discharge to be effective immediately;

AND

It is the judgment of this Board that Senior Sgt. Cauley be reduced in rank to Sergeant and assigned to a Sleeper Patrol forthwith, for the period of six months, whereafter his conduct shall be reviewed by this Board.
